The Failure of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the tension sparked by the announcement of a new 28-article proposal for ending the war appeared – momentarily – to have been contained. A American diplomat spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its response: another massive barrage of missile and drone strikes on Kyiv.

The Cycle of Peace Talks and Military Action

The chain of conflicting incidents captured the bleak nature of the current period. By day, negotiation efforts are fought: positive announcements are issued from different nations. Considerable effort is expended on restraining specific proposals. By night, Russian leadership forcefully demonstrates the world that, for them, war remains the key method for achieving "settlement".

After-Dark Attacks

As the offensive progressed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was exposed. Ukraine is equipped to monitor rocket firings from Russian territory, a capacity enabled by timely intelligence. From witness perspectives, defense planes that had been scrambled to intercept incoming guided weapons streaked across the sky – advanced fighter aircraft delivered to Ukraine by NATO members.

Soon thereafter, Kyiv's missile defense thundered: defensive missiles targeted at a incoming threat. This was a sophisticated defense system at work, most likely delivered by partner states. Every deployment jolts you unexpectedly, rattling buildings. The moment of terror quickly becomes resigned acknowledgment: perhaps the incoming missile won't cause damage this time, protecting urban areas from ruin and further power outages.

Persistent Threats

Soon after, a automatic firearm engaged a drone close by, part of a rapid response unit – probably imported technology. Regrettably, the projectiles didn't strike the enemy aircraft – it pressed on overhead toward its destination.

Intermittently, this carried on until dawn. Kyiv awoke to the daybreak reports: multiple fatalities, devastation and utility failures in numerous residences as a result of the nocturnal offensive. As customarily, everyone still went about their day – experiencing conflict. But those entire period encapsulated Ukraine's critical military reliance on Western support – a reliance that European nations are evidently unprepared to fill in the immediate future.

Ineffective Peace Efforts

The detailed framework from Washington provoked deep reactions, controversy and deep concern – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and multilateral gatherings.

Every new proposal from Washington adheres to the same pattern: a political offensive against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They contain the crisis but never actually secure success. This trend will, no doubt, endure.

Tactical Assessments

It is tempting to accuse specific actors of consistently pushing Russian terms. But that does not seem to be the whole story. US administration functions according to a assumption familiar among seasoned negotiators: you cannot achieve through diplomacy what you have lost on the battlefield. The White House assumes that it is impossible to compel Moscow to surrender the territory that it currently occupies in Ukraine's occupied territories.

The challenge is that while recognising this factual reality, US leadership does nothing to prevent Kremlin actions, through statements or actions, from assuming that the current condition will not evolve additionally in its favour in the coming year.

Divergent Views

Therefore, the Kremlin is confident that time is on his side – that Ukraine and its supporters are nearing depletion. Their motivation to sign a deal that does not give them the largest achievable advantage is close to zero. There may be multiple initiatives to stop fighting, but they will carry on as long as Russia's leadership remains highly assured in the outcome.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, slowly losing people and territory but averting a total frontline collapse until conditions improve in its favour.

Existing Situation

Objectively, there are no genuine requirements for a truce. Now, personal considerations are entering the equation: leadership ambitions to mediate resolution and achieve global acclaim, and Ukrainian leadership's dual difficulties – on one hand, not to distance important partners, and on the other, to unite the population around the flag against any plan Kyiv finds unsuitable, so that their focus does not shift toward internal issues. And although their task will now be considerably more difficult after latest incidents, it remains highly unlikely that this will change their overall approach.

These conflicting dynamics are driving the talks.

Assessment and Future

It took a just a single week to kill the 28 points of the most recent proposal. Forceful and unpredictable management of the matter by Washington, resistance by Ukraine and the remaining European nations, along with soothing efforts of diplomats, and finally, recent disclosures, all served their function.

While new initiatives based on old ideas are forthcoming, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are rooted in Kremlin requirements and demonstrate certain reluctance to alter the situation, if they remain united and improve their protective measures at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the foreseeable future, largely rely on continued Western support.
